Terms of Use

Agreement

MethGator.io (the “Game”) is a free browser game at https://methgator.io (the “Site”), operated by Kevin Thomas Kehoe (“Operator”, “we”, “us”). By loading or playing the Game you agree to these terms. If you do not agree, do not use the Game.

These terms work together with the Privacy Policy, which describes what the Game collects and why.

Eligibility and licence

You must be at least 13 years old to play. If you are under 18, you confirm that a parent or legal guardian permits you to play.

The Operator grants you a personal, non-exclusive, non-transferable, revocable and limited licence to play the Game for your own non-commercial entertainment in a compatible web browser. No other rights are granted.

The Game is free and provided as-is

The Game is free to play. There are no purchases, no virtual currency and no virtual goods. Nothing in the Game is bought, sold or owned, and nothing in the Game has monetary value.

THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. The Operator does not guarantee that the Game will be available at any given time, that it will be uninterrupted, secure or error-free, that matches will complete, or that scores, rankings or progress will be recorded or preserved. You play at your own risk.

The Operator may change, suspend or discontinue any part of the Game, including maps, game modes, at any time and without notice.

Acceptable use

You agree not to:

Modify the client, automate play, or use any bot, script, macro, mod or third-party program that plays on your behalf or gives you information the Game does not give other players.
Send data to the server other than what an unmodified client sends in normal play.
Attempt to disrupt, overload, reverse-engineer or gain unauthorised access to the service, its source code, its hosting, or other players' connections.
Exploit a bug rather than report it, where doing so disrupts the game for other players or produces results you did not earn.
Choose a display name or lobby name that is unlawful, harassing, hateful, sexually explicit, or that impersonates another person.
Use the Game for any unlawful purpose.

The Operator may remove any lobby, disconnect any player, block any IP address at any time, for any reason, without notice and without liability.

Names and other content you supply

Display names and lobby names you enter are shown to other players in the same lobby. Do not enter anything you would not want another player to see. You are responsible for what you type.

Display names and lobby names are held in memory for the life of a match and are not stored afterwards. See the Privacy Policy.

Intellectual property

The Game and its source code, artwork, animations, sounds, gameplay mechanics and name are the property of the Operator or its licensors. You may not copy, modify, distribute, sell or use any part of the Game to operate a competing service, except as expressly permitted in writing or by the applicable licence.

Map outlines are derived from public-domain US Census cartographic boundary data.

Children

The Game is not directed at children under 13, and the Operator does not knowingly collect personal information from them. See the Privacy Policy for what the Game does and does not collect, and for how to contact the Operator if you believe a child has supplied personal information.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF PROGRESS, LOSS OF RANKING, SERVER DOWNTIME OR LOSS OF GOODWILL, ARISING OUT OF OR CONNECTED WITH YOUR USE OF OR INABILITY TO USE THE GAME, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE OPERATOR'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE GAME IS LIMITED TO THE AMOUNT YOU PAID TO PLAY IT, WHICH IS USD $0.00.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, these terms do not affect your statutory rights.

Indemnity

You agree to indemnify the Operator against any claim, loss or expense arising from your breach of these terms or your misuse of the Game.

Changes

These terms may change. Changes take effect when posted to this page, and the effective date at the top will change with them. Continuing to play after that date means you accept the revised terms.

General

If any provision of these terms is held unenforceable, the rest remain in effect. A failure to enforce a provision is not a waiver of it. These terms are the entire agreement between you and the Operator about the Game, and you may not transfer your rights under them.
